Terms & Conditions
Definitions
- The "buyer" means the company or person who buys or agrees to buy goods from the seller.
- The "seller" means Mrs Jennifer Chappell (proprietor of Willowbrook Farm and Willowbrook Equestrian) a company trading in the UK operating under English law.
- "Conditions" means the conditions of sale set out below.
Conditions
- All transactions between the seller and the buyer are accepted on these terms only.
- It is the responsibility of the buyer to read these terms before entering a transaction.
- Orders are accepted by the seller on the basis that these terms are accepted by the buyer.
- Acceptance of delivery is deemed conclusive evidence of a buyer's acceptance of these terms.
- These terms override any that a buyer may try to apply under its own order documentation.
- No variation to these terms shall be effective unless agreed in writing by the seller.
- Acceptance of delivery is deemed conclusive evidence of a buyer's acceptance of these terms.
- Nothing in the terms affects the statutory rights of any buyer more than the law permits.
- The seller reserves the right to change and to display new terms on its website at any time.
- The terms of each contract are based on the terms current at the time of order acceptance.
- The seller aims to describe goods accurately but apologises if any occasional errors occur.
Orders
- Acceptance of orders is at the seller’s sole discretion.
- No contract for the sale of goods shall arise until the seller positively accepts a buyer’s order.
- To order goods and enter a legally binding contract with the seller buyers must be over 18.
- Buyers must provide their correct name, address and credit/debit card details to buy online
- Buyers must provide their correct name, address and telephone number to order goods.
- Buyers must be fully entitled to use the credit / debit card provided at time of online order.
- Buyers must have sufficient funds available at the time of order to cover the full cost.
- Buyer mistakes during checkout must notified to the seller within 24 hours of the order.
- The seller may correct notified mistakes, cancel or refund order transactions at its discretion.
- Buyers may change order detail at any time up to the point of payment during checkout.
- Online orders are confirmed following checkout but goods availability is subject to change.
- Confirmed orders are not binding upon the seller until positively accepted by the seller.
- The seller will inform the buyer if it is unable to accept the order and refund any money paid.
- The seller will make reasonable effort to deliver accepted orders inside stated delivery times.
- Buyers must ensure that goods ordered are suitable for their purposes and requirements.
- The risk in goods shall pass to the buyer upon despatch or upon appropriation by the buyer.
- The seller remains the owner of the goods until the buyer had paid in full for the goods.
Cancellation and Refunds
- No goods are sold to the buyer on a sale or return basis as all goods are created to order.
- Orders cannot be cancelled, rejected or returned except on terms at the seller’s discretion.
- The seller takes great care to ensure that orders are dispatched in perfect condition.
- The seller will provide a refund or exchange only if goods are faulty or damaged in transit.
- The seller accepts no refund responsibility for customer order input error or spelling mistake.
- Order amendments received after the goods are created are not eligible for a refund.
- Faulty or damaged goods must be reported to the seller by email within 48 hours of delivery.
- Faulty or damaged goods must be returned to the seller in its original packaging for a refund.
- The buyer is liable for damage to returns caused by inadequate packaging by the buyer.
- The seller is entitled to make a handling/restocking charge of 25% on returned goods.
- Any refund that may be considered is at the sole discretion of the seller.
Online Credit Card Payment
- The seller never sees the buyer’s credit or debit card details when they buy online.
- The online payment screen is located our third party payment provider’s secure server.
- The third party payment provider’s secure server employs the highest standards of security.
- The third party payment provider processes payment and confirms the order to the seller.
- Once confirmed the third party payment provider passes buyers back to the seller’s website.
- Buyers must ensure that credit/debit card and delivery details they enter online are correct.
- The seller accepts no responsibility for delay resulting from incorrect payment/delivery detail.
- Where a buyer pays but an order / part order is not accepted a (part) refund may be issued.
Prices
- All prices on the seller’s website are in UK Pounds Sterling and are exclusive of delivery costs.
- The price shall be the seller's current price list or if applicable that in the seller's quotation.
- The seller may vary without any liability the website content, goods prices and descriptions.
- The seller reserves the right to revise prices prior to order acceptance with buyer agreement.
- The seller has the right to refuse to accept any order or part of an order if its costs change.
- Online order value is displayed on screen in UK sterling during checkout / order confirmation.
- For overseas buyers the appropriate foreign exchange rate will be applied to the order.
Delivery
- Delivery is normally within 7 - 10 working days but some items can take up to 28 days.
- Where possible the seller dispatches UK orders 7-10 working days from order acceptance.
- Standard UK delivery costs are stated for each item assuming 2nd class delivery via Royal Mail.
- Local delivery by Willowbrook transport is capped at £10 within 30 miles and £5 within 15 miles.
- Free delivery is offered on local delivery orders within 15 miles of Willowbrook Farm.
- Rest of the world delivery is usually within 28 days depending on the exact delivery address.
- If delay is likely the seller will contact the buyer but delivery time shall not be of the essence.
- Any dates provided for delivery are approximate only and late deliveries will not be refunded.
- The seller is not liable for buyer losses, damages or costs resulting from delayed delivery.
- If goods are required urgently buyers can contact the seller to make special arrangements.
- The method of delivery and delivery provider is at the discretion of the seller.
- Unless otherwise agreed the seller may deliver multiple item orders by separate instalments.
- Each instalment delivery shall be treated as a separate contract.
- Instalment delivery delay or default shall not entitle a buyer to cancel remaining instalments.
- Buyers must arrange to take delivery of goods when they are tendered for delivery.
- The seller is not responsible for late or failed delivery if the address provided is incorrect.
- The seller obtains ‘proof of despatch’ from the delivery service used.
- The seller is entitled to require a ‘proof of delivery’ signature from the buyer on delivery.
Undelivered Orders
- UK orders not received must be notified to the seller within 10-20 working days of order.
- Failure to notify non delivery will result in the seller not accepting non delivery responsibility.
- Orders returned as undelivered for the following reasons will not be refund by the seller:
- Package not called for
- Addressee unknown
- Addressee gone away
- Address incomplete
- Address incorrect (inc. postcode)
- Item refused
- No answer
- If revised delivery details are provided the seller will resend goods on further payment.
- The seller will use reasonable efforts to attempt to contact the buyer to arrange re-delivery.
- After six months undelivered orders will be deemed to have been completed in full.
Warranty and Liability
- The seller warrants that goods correspond to the description provided on order acceptance.
- All other warranties, conditions or terms relating to fitness for purpose, merchantability or condition of the goods, whether implied by statute, common law or otherwise are excluded and the buyer warrants that they are satisfied as to the suitability of goods for their purpose.
- Except as may be implied by law where the buyer is dealing as a consumer, in the event of any breach of these conditions by the seller the remedies of the buyer shall be limited to damages which shall in no circumstances exceed the price of the goods and the seller shall under no circumstances be liable for any indirect, incidental or consequential damages.
- Except in the case of death or personal injury caused by negligence on behalf of the seller, the seller will not be liable to the customer by reason of any representation, implied warranty, condition or other term, or any duty at common law, or under the express terms of the conditions for any consequential loss or damage (whether for loss or profit or otherwise), costs, expenses or other claims for consequential compensation whatsoever which arise out of, or in connection with the supply of the goods or their use or resale by the buyer.
- Whilst the seller endeavours to keep the website and emails free from viruses, trojans, worms and any other similar such ailments, the seller shall not be liable to the customer or site visitors for any destructive results.
- The seller accepts no liability for any loss or damage resulting from any use of the products.
- The seller’s website does not knowingly link to obscene, pornographic or illegal sites.
- The seller accepts no responsibility for the content of any website that it links to.
- The seller will not be under any liability whatsoever in the event that the seller is prevented or delayed from supplying or making delivery of any goods for any reason or cause beyond the seller's reasonable control.
No waiver
- The seller's failure to insist upon strict performance of any provision of these conditions shall not be deemed to be a waiver of its rights or remedies in respect of any present or future default of the buyer in performance or compliance with any of these conditions.
Copyright
- The seller’s website and content is copyright of the seller or its content / technology partners.
- Buyers / site visitors may not copy, modify, distribute or republish the website or its content.
- ALL RIGHTS RESERVED.
Governing Law
These terms and conditions and any legal relationship between the buyer and/or the recipient of the goods and the seller shall be governed by the law of England and submitted to the exclusive jurisdiction of the English Courts, but without prejudice to the right of the seller to seek recovery of any sums due to it before any court of competent jurisdiction.
